In the event that Sagardoy Abogados, in order to provide the legal services requested, were to act as data processor of a client’s personal data, of which said client is data controller, appropriate steps have already been taken to ensure compliance with the following legal obligations:

  • Process personal data to which we have access solely for the purpose of providing the legal services requested by the data controller, in accordance with their instructions, including for the purpose of international data transfers to a third country, unless we are required to process said personal data under European Union or national law, in which case we shall inform the data controller, except when prohibited from doing so for significant reasons of public interest;
  • Not use said personal data for our own purposes or for purposes other than the provision of the legal services requested
  • Guarantee that those under our authority, whether employees or collaborators, are —either contractually or pursuant to a legal obligation— required to keep secrecy or confidentiality with regard to the processed personal data, even after their relationship with Sagardoy Abogados has terminated;
  • Take appropriate technical and organisational measures to ensure that the level of security is consistent with the potential risk under the applicable regulations on personal data protection;
  • Use other data processors (such as solicitors, translators, etc.) only when strictly necessary for the provision of the legal services requested by the data controller, in which case they will have adopted or will adopt appropriate technical and organisational measures to ensure compliance with data protection regulations. In this regard, and on the basis of the foregoing, the client expressly authorises Sagardoy Abogados to use other data processors;
  • Assist the data controller, if necessary, in the fulfilment of their obligation to deal with requests for the exercise of data protection rights and, where appropriate, inform them of any request that we may receive so that they may proceed in accordance with their applicable obligations;
  • Delete or return personal data after the completion of the provision of legal services, unless bound by a legal obligation to retain such data under European Union or national law, and
  • Make the information necessary for the fulfilment of their obligations available to the data controller.

In turn, the data controller undertakes to:

  • Adopt and implement the necessary measures to provide data subjects with information on the processing of their personal data, in accordance with the principles of information and transparency.
  • Adopt and implement the necessary measures to obtain and manage the consent required for the processing of personal data of the data subjects concerned throughout their life cycle (from collection to deletion).
  • Hold the data processor harmless in respect any liability that may be claimed by a competent authority or third party under administrative or judicial proceedings, including the right to compensation that may be claimed by a data subject on the grounds of failure to adopt and implement measures that the data controller may have failed to inform of.
  • Fulfil all other obligations that may be required of them.

The request for legal services to Sagardoy Abogados on the part of any client who acts as data controller shall be made in accordance with the procedures stated herein and without prejudice to the execution of a contract or agreement detailing the access to personal data by the data processor.


Sagardoy Abogados has taken appropriate technical and organisational measures to ensure an adequate level of security in view of the nature and purposes of the personal data processed, as well as of the potential risk.

Notwithstanding the foregoing, it is necessary that you also take measures when navigating the Internet or providing personal data, so as to ensure that said data are properly processed.
